Privacy policy

This Privacy Policy is only applicable to information collected by the Administrator through the Portal. The Privacy Policy has information on how the Administrator: collects, uses and protects information concerning the Users, including the Data, in the Portal.

Any definitions or phrases capitalized in the Privacy Policy as well as other terms included and used in this document have, first of all, the meaning defined in the TrainMe Portal Terms and Conditions.

The administrator of the Data is the Administrator.  By using the Portal the User gives his/her Consent to collect and process Data concerning him/her on the terms described in this Privacy Policy. Any Data is processed pursuant to the Act dated August 29, 1997 on personal data protection and its executive acts. In the scope not regulated by the provisions of this Privacy Policy the relevant conditions of the Terms and Conditions, regulations of the Act dated August 29, 1997 on personal data protection and standards articulated in other relevant legal regulations in the Territory apply.

As a matter of principle, browsing the Portal without using any Services or Functionalities if of anonymous nature. During such browsing, Data is not collected, including the surname, address, phone number or e-mail address.

Entering the Data is, as a matter of principle, of voluntary nature but may be a condition for using specific Functionalities in the Portal.

The scope of Data which will be collected for the User to use a specific Service, Functionality or other form of cooperation is each time specified in detail in a relevant form with the Consent clause.

Registered Users and Users who decided on Services or Functionalities or other forms of cooperation which do not require an Account - should be aware of the fact that the Administrator may process the Data of these Users in the scope provided to him/her.

The User acknowledges and agrees that:

  1. the limitation or ban on the appearance of software, type cookies, as part of the User's End Devices may generate a negative effect of using the Portal; 
  2. the Administrator may store the Data or other information related to the User's End Devices in the form of software, type cookies, to which the Portal's functioning is related; 
  3. the Administrator may store or share the Data, if this is required by law or if this is necessary for the needs of legal actions; the implementation of the Contract or providing a reply to reported violations, referred to below.

The Data is collected for the purpose and in the scope related to: allowing the Users to use the Account, the Content, Services, the Application or Functionalities; the implementation of the Contract; the Administrator's replies to inquiries, notifications or applications from the Users or reported violations of Rights of Goods, as well as meeting legally justified objectives by the Administrator as the administrator of the Data.

The Users are entitled to access to the content of the Data concerning them and correct them. In cases listed in Article 23 section 1, item 4 and 5 of the Act dated August 29, 1997 on personal data protection, the User has the right to a written (delivered to the address of the Customer Service Office), justified request to cease the processing of his/her Data and the right to file an objection against the processing of his/her Data for marketing purposes.

As part of cooperation with prosecuting authorities and other  third parties in order to enforce the protection of Rights, Goods or other rights, the Administrator may lawfully disclose the Data concerning the Users.

The Administrator accepts a possible entrusting of the processing of necessary Data of Registered Users, on the basis of contract specified in Article 31 of the Act dated August 29, 1997 on personal data protection only to the extent and for the purpose necessary for the proper implementation of some Services or Functionalities by or with the participation of Partners.

On-line advertisements in the Portal do not collect any Data of particular Users.  This also applies to Banners.

As a matter of principle, it is possible for the User to resign from the processing of "cookie" files by his/her browser, but this may bring a negative effect of using the Portal.

In order to protect against unauthorized access, unauthorized change, disclosure or destruction of the Data, the Administrator implements appropriate safety measures. Already at the stage of selecting the technology and architecture of the Portal, specified technological choices aiming at increasing the protection of Data sent to or from the Portal using the Network were made.

However, the User should be aware of the fact that nobody can guarantee 100% of data transmission safety when using the Network. Therefore, despite his/her efforts, the Administrator cannot guarantee and does not guarantee the safety of information, including data sent to or from the Portal, as part of using the Services, the Application or Functionalities.

The Administrator or the competent Partner provide the User with access to information about:

  1. particular hazards related to using the Service provided by him/her,
  2. the function and purpose of the Software or data not being a component of the content of the provided Service, introduced by the Administrator or the Partners to the System used by the User.

The Portal uses Google Analytics, an on-line tool used for analyzing website traffic, shared by Google Inc. ("Google").  The User should be aware of the fact that Google Analytics uses "cookies" files, namely text files created on the User's computer the content of which makes it possible to analyze how Users use a given website. Information generated by "cookies" files on using the website by the User (including his/her IP address) are collected by Google and stored on servers in the United States. This data will be used to evaluate the User's use of the website, but also to create reports concerning traffic on websites for website operators or to provide other services related to website traffic and using the Internet. Google may also transfer this information to third parties if it will be obliged to do so on the basis of legal regulations or when these parties process such information on behalf of Google. The User's IP address will not be linked with any other data owned by Google.
